Fix Code Review AI features policies to check duo features enabled toggle

What does this MR do and why?

We are backporting !165021 (merged) since 17.3 is the minimum version required for customers to use the GitLab Duo Enterprise add-on.

Customers should be able to turn off AI features at the group/instance level starting from that version.

This bug fix is required to make disabling of Duo for CLI and Generate Merge Commit Message possible.
